1. Acceptance of Terms

By accessing or using CryptoTopCard ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. CryptoTopCard reserves the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms.

The Service is available to users worldwide, subject to the restrictions outlined in these terms. You must be at least 18 years old or the age of majority in your jurisdiction to use CryptoTopCard.

2. Service Description

CryptoTopCard provides virtual Visa and Mastercard prepaid cards that can be funded using cryptocurrency. Our service operates without Know Your Customer (KYC) identity verification. Cards are issued for online transactions including advertising, subscriptions, and general purchases.

• Virtual card issuance with multiple BIN options
• Cryptocurrency deposits (BTC, ETH, SOL, USDT)
• Dashboard for card management, funding, and transaction monitoring
• REST API for programmatic card operations
• 3D Secure 2.0 authentication support

3. Account & Authentication

Accounts are created using a unique seed phrase generated at signup. You are solely responsible for safeguarding your seed phrase. CryptoTopCard does not store seed phrases and cannot recover lost credentials. If you lose your seed phrase, access to your account and any remaining balance will be permanently lost.

You agree not to share your seed phrase with any third party. Any activity that occurs under your account is your responsibility.

4. Card Usage

Virtual cards issued through CryptoTopCard are prepaid instruments intended for legitimate online purchases. Each card is subject to the following conditions:

• Cards may only be used for lawful transactions in jurisdictions where such use is permitted
• Transaction and monthly spending limits vary by card type and BIN
• Cards are non-transferable and intended for use by the account holder only
• Merchants may decline transactions at their discretion regardless of available balance
• Cards can be added to Apple Pay and Google Pay for contactless payments where supported

5. Crypto Funding & Deposits

CryptoTopCard accepts deposits in Bitcoin (BTC), Ethereum (ETH), Solana (SOL), and USDT (ERC-20). Deposits are credited to your account after the required number of blockchain confirmations.

• Deposit amounts are converted to USD at the prevailing exchange rate at the time of confirmation
• CryptoTopCard is not responsible for losses due to cryptocurrency price fluctuations between the time a transaction is initiated and confirmed
• Deposits sent to incorrect wallet addresses or on unsupported networks cannot be recovered
• Minimum deposit amounts may apply depending on the cryptocurrency used
• A funding fee of up to 2% may be applied to deposits as outlined on the pricing page

6. Fees & Pricing

CryptoTopCard charges a per-card issuance fee and may charge transaction fees, funding fees, and decline fees. Current pricing is displayed on the pricing section of our website. Fees are subject to change with notice posted on the Service.

All fees are non-negotiable unless you are on a custom enterprise plan. Fees are deducted from your account balance at the time of the relevant action.

7. Prohibited Activities

You agree not to use CryptoTopCard for any of the following:

• Fraud, identity theft, or any form of financial crime
• Money laundering or terrorist financing
• Purchasing illegal goods or services in any jurisdiction
• Carding, unauthorized testing of card numbers, or BIN attacks
• Circumventing merchant restrictions or platform policies through deceptive means
• Reselling cards or card details to third parties
• Using automated systems to abuse the Service beyond authorized API usage
• Any activity that violates applicable laws, regulations, or card network rules

CryptoTopCard reserves the right to determine, in its sole discretion, whether any activity constitutes a violation of these terms.

8. Account Suspension & Termination

CryptoTopCard may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms of Service or engaged in prohibited activities. Upon termination:

• All active cards will be immediately frozen and deactivated
• Any remaining balance may be forfeited if the account was terminated due to policy violations
• Access to the dashboard and API will be revoked
• CryptoTopCard is under no obligation to provide reason for termination

You may close your account at any time by contacting support. Remaining balances on accounts closed voluntarily may be refunded at CryptoTopCard's discretion, minus any applicable fees.

9. Refund Policy

Card issuance fees are non-refundable. Once a card has been created, the issuance fee cannot be returned regardless of whether the card was used.

• Unused card balances may be withdrawn or transferred to new cards, subject to applicable fees
• Declined transactions do not result in charges to the card balance, though decline fees may apply
• Refunds from merchants will be credited back to the card balance
• Cryptocurrency deposits are non-reversible by nature and cannot be refunded in their original form
• CryptoTopCard does not issue refunds for exchange rate fluctuations

10. Limitation of Liability

CryptoTopCard provides the Service on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Service's reliability, availability, or fitness for a particular purpose.

To the maximum extent permitted by law, CryptoTopCard shall not be liable for:

• Merchant declines or transaction failures
• Losses resulting from cryptocurrency price volatility
• Unauthorized access to your account due to compromised seed phrases
• Service interruptions, downtime, or data loss
• Indirect, incidental, consequential, or punitive damages arising from use of the Service
• Actions taken by card networks, payment processors, or merchants

In no event shall CryptoTopCard's total liability exceed the amount of fees paid by you in the 30 days preceding the claim.

11. Intellectual Property

All content, trademarks, logos, and software associated with CryptoTopCard are the property of CryptoTopCard or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Service. Visa and Mastercard are registered trademarks of their respective owners.

12. Dispute Resolution

Any disputes arising from these terms or your use of the Service shall be resolved through binding arbitration. You agree to waive any right to a jury trial or participation in a class action lawsuit. Claims must be brought within one (1) year of the event giving rise to the dispute.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable international commercial law. CryptoTopCard operates as a global digital service and is not subject to the exclusive jurisdiction of any single country.
